II. Provision of the online offer
Every time you visit our online offer, we or our hosting provider collect some general information and information from the computer system of the computer accessing our site. Among others, the following data may be collected:

The legal basis for the temporary storing of the data in the log files is Art. 6 (1) lit. f GDPR. Because collecting the data is essential to making the online offer available and storing the data in log files is essential for the operation of our online offer, you as user cannot object to the processing of these data.
III. Application form for models
f you are interested in being added to our model database, you can submit an application via our website. For this purpose we provide a make an application form for you on our website. When you submit your application to us, the information you provided to us will be forwarded to us so we can check your application. We process your data exclusively for the purpose of verifying your application. You will be informed via e-mail when your profile has been activated successfully. Once your profile is activated, the information and pictures you provided will be visible to all visitors to our website.
The following data you enter will be forwarded to us and stored:

- five body images,
- location, zip code,

- body measurements (chest measurement, waist circumference, hip circumference, clothing size, and body size),

The legal basis for processing is Art. 6 (1) lit. b GDPR (contract initiation). We will store your data for the time it takes to verify them. If your application is accepted, your data will be transferred into the model database and stored there. If your application is rejected, we will delete your data immediately upon completing the verification.
IV. Completing your model profile
Once your profile is activated, you can add more information to it. That information is necessary so that we can recommend you for particular modelling jobs.
You can enter the following information yourself in your model profile:
- Gender
- First name
- Last name
- Place of residence / city & state
- Nationality
- Date of birth
- Place of birth
- Employment status / current employment
- Phone number
- E-mail address
- Vegan or vegetarian lifestyle
- Any food intolerances or allergies you have
- Instagram media data / Insights starting at 5k followers
- Banking information (payment of fee in case of bookings)
- Tax ID (tax identification number)
- Subject to VAT / VAT exempt
- Tax number (if subject to VAT)
- Types of sports
- Pro athlete / professional athlete / athlete active in clubs (any successes in sports)
- Membership in which company of the RSG Group (e.g., McFIT, John Reed etc.)
- Conspicuous or large-scale tattoos / piercings / conspicuous scars. And where they are located
- Bra size
- Shoe size
- Suit size (men)
- Hair colour
- Hair length
- Eye colour
- Height
- Body measurements (chest / waist / hip)

The legal basis for the processing of these data is Art. 6 (1) lit. b GDPR. We store your data until you request the deletion of your profile.
V. Contact form and e–mail contact
You can get in touch with us via the e-mail address phone number provided or via the contact form. If that case, we will process your e-mail address or phone number. If you contact us via the contact form, we will process your email address, form of address and your message. It is entirely up to you what additional information you provide.
The legal basis for processing these data for the purpose of replying to your inquiry is Art. 6 (1) lit. f GDPR. If your inquiry is about placing models, for example, then processing is based on Art. 6 (1) lit. b GDPR.
The above-mentioned personal data are deleted after your inquiry has been resolved. An inquiry is resolved when it is clear from the situation that the matter has been settled conclusively.

VI. Use of cookies
We use cookies on our website. Cookies are small text files that are stored in your internet browser or by your internet browser on your computer system. Cookies are downloaded when you visit a website. These cookies contain a characteristic character string that allows an unequivocal identification of your browser the next time you access the website. With the help of this cookie the website can recognise that it has been accessed with this browser before; among other things, this can help improve your user experience in this new visit. 2. Use of Cookiebot
We have integrated the service ‘Cookiebot’ of the provider Cybot A/S, Havnegade 39, 1058 Copenhagen, Denmark. Cookiebot allows us to obtain your consent regarding use of our tools in compliance with data protection requirements. In addition, Cookiebot prevents the collection of personal data through tools until you have provided your individual consent. The following data are collected in this process:
- The IP number of the end user in a anonymised form (the last three digits are set as ‘0’),
- Date and time of the consent,
- User agent of the end user’s browser,
- The URL from which the consent was sent,
- An anonymous, random and encrypted key ,
- The end user’s consent status, which serves as proof of consent.
The key and your consent status will also be stored in a cookie ‘CookieConsent’, so that for a period of up to 12 months our online offer can automatically read and respect your consent in your subsequent visits to the pages and your future user sessions. We will process the data provided by you exclusively for the purpose of documenting and being able to prove your consent. The use of our tools in compliance with data protection requirements is also our legitimate interest (Art. 6 (1) lit. f GDPR).

VII. Use of Google Analytics
On our website we use the Auf tracking tool ‘Google Analytics’ of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. With the help of cookies Google Analytics primarily captures your interactions and analyses them. The following data are is collected in this process:
- three bytes of the IP address of the user’s system accessing the website (anonymised IP address),
- the website accessed ,
- the website accessed previously (referrer URL),
- the subpages that were visited from accessed page,
- the duration of the visit on the website,
- the frequency of visits to the website.
Google Analytics is set up so that your IP address is not stored in its entirety; rather the last octet of the IP address will be masked (for example: 192.168.79.***). In this way the truncated IP address cannot be linked to your terminal anymore.
Google Analytics allows us to analyse the surfing behaviour of visitors to our website. By analysing the data collected we can compile information about the use of the individual components of our website. This helps us to continuously improve the website and make it more user-friendly.
The legal basis for the processing of your personal data is Art. 6 (1) lit. a GDPR (consent). You can give your consent via the cookie banner. Your data will not be processed until after you have given your consent.
You can object to personalised advertising by Google in the settings for advertising (https://adssettings.google.com/authenticated). These settings are saved in your Google account (if you are logged in) or in your browser (if you are not logged into your Google account). The predefined settings (for users not logged into Google) must be made again if you use a different browser or delete your browser settings.
You can prevent Google from collecting and processing the cookie-generated data by about your use of the website (including your IP address) by downloading and installing a browser plug-in that deactivates Google Ads; simply download the specific plug-in for your browser, Chrome, Firefox or Internet Explorer (https://www.google.com/settings/ads/plugin).

The data collected by means of the tracking are deleted as soon as we no longer need them for our recording and analysis purposes. Generally, this will be the case after 26 months.
Because of different regulations (e.g., the CLOUD Act) we cannot rule out data transfer to the United States. We have concluded a processing contract with Google Ireland Limited that includes so-called standard contract terms and ensure appropriate data security guarantees.
VIII. Newsletter dispatch
If you register for the newsletter, you agree until revocation that you receive a personalized newsletter from McFIT Model Agency GmbH and that we may send you advertising on products, services, promotions and satisfaction surveys. In order to send you an optimized newsletter, you consent to an evaluation by the aforementioned companies, which measures whether and when the newsletter is opened and which links you click on. 2. Legal basis and purpose for data processing
The legal basis for sending the newsletter and the performance measurement associated with it is your consent pursuant to Art. 6 (1) lit. a DSGVO.
The logging of the registration process is based on our legitimate interest pursuant to Art. 6 para. 1 lit f DSGVO. Here, our interest is directed towards the use of a user-friendly and
secure newsletter dispatch process, which on the one hand serves our business interests and enables us to prove your consent and at the same time also meets your expectations.
The processing of your e-mail address serves to deliver the newsletter to you.
3. Duration of storage
The data will be deleted as soon as they are no longer required to achieve the purpose for which they were collected. Your e-mail address will therefore be stored for the newsletter dispatch as long as you have subscribed to a newsletter.

In order to be able to prove a previously given consent, we can store the unsubscribed e-mail address for up to three years on the basis of our legitimate interests before it is deleted. In this case, it is only stored for the purpose of possible defense against claims.
4. Newsletter dispatch by MailChimp
The dispatch of our newsletter is carried out by means of the dispatch service MailChimp, a service of the US provider The Rocket Science Group LLC, 675 Ponce De Leon Ave NE, Suite 5000, Atlanta, GA 30308, USA (hereinafter “MailChimp”). MailChimp is certified by the Privacy Shield and we have a Order Data Processing Agreement with them.
We use MailChimp on the basis of Our legitimate interest pursuant to Art. 6 para.1 lit. f DSGVO.
MailChimp may use the recipients’ data without attribution to a specific user to optimize or improve their own service, e.g. for the technical optimization of the dispatch and the improvement of the presentation of the newsletter. MailChimp will not use the data of our newsletter recipients to contact you itself or to pass it on to third parties.
The registration for our newsletter is done by double opt-in at MailChimp and is documented accordingly. In the event of unsubscription, the data will be deleted from MailChimp.
5. Newsletter success measurement
The newsletters may contain so-called “web beacons”. These are pixel-sized files that are retrieved from our server or from the server of our shipping service provider when a newsletter is opened. As part of this retrieval, technical information such as information about your browser and your operating system, but also your IP address and the time of retrieval of the newsletter are collected.
The legal basis for the processing of data with regard to the newsletter performance measurement is Art. 6 para. 1 lit. f DSGVO.
All this information is used to improve the service based on the technical data or the target groups and their reading behavior based on the retrieval locations or access times. Also collected is the determination of whether the newsletter was opened, when it was opened and which links were clicked. Even if this information can be assigned to an individual newsletter recipient for technical reasons, neither we nor the dispatch service provider will monitor individual users. The analyses serve us to recognize the reading habits of our users and to adapt our content to them or to send interest-oriented newsletters to our users.
IX. Right to object
We use a number of tools on our website for which we require your consent before data processing can take place. You can specify your consent based on your preferences via our cookie banner, which appears in the lower half of the display when you visit our site for the first time. X. Transfer of data to service providers and other third parties
Various service providers are active for us on the operation and optimisation of our online offer and also for our services and for contract processing, e.g., for central IT services or for hosting our online offer. XI. McFIT Model Agency on social networks /platforms
Because we want to communicate with our clients, interested parties and users, we also maintain a social media presence with our own pages on social networks (such as Facebook and Instagram, for example). There we also provide information about our services. When you retrieve visit our pages on those networks or platforms, the terms and conditions and data protection guidelines of the operator concerned apply.
By way of the icons of the social networks that are embedded into our home page we do not process any personal data. Only when you actively click on those icons do you activate the background link and are redirected directly to our online presence on the corresponding social network. Your personal data are processed by the network when you visit our pages there. For your information we have included below the links to the privacy notices of the networks we use.
We want to point out that the user data of social networks are generally processed by these networks for their market research and advertising purposes. Based on user behaviour user profiles can be generated. These can be used, for example, to display advertisements even outside of the network.
